Terms of Use — Dendrites

These terms apply to the Dendrites app, including the BORROW puzzle and the Dendrites Plus subscription. By downloading or using Dendrites, you agree to them. If you do not agree, do not use the app.

1. Apple's license agreement

Dendrites is licensed to you under Apple's Licensed Application End User License Agreement. These terms add to that agreement. If anything here conflicts with Apple's agreement, Apple's agreement controls.

2. Your license to use Dendrites

We give you a personal, non-exclusive, non-transferable, revocable license to use Dendrites for your own non-commercial entertainment. You may not copy, modify, reverse engineer, or redistribute the app or its puzzles, or tamper with it to unlock subscription content, change solve times, or alter records.

3. Dendrites Plus subscription

• What you get. Dendrites Plus unlocks five additional daily puzzles each day, on top of the three free daily puzzles that are always available.
• Billing. Dendrites Plus is an auto-renewable monthly subscription. The price is shown in the app before you subscribe. Payment is charged to your Apple Account when you confirm the purchase.
• Automatic renewal. Your subscription renews automatically each month at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
• Cancelling. You can manage or cancel your subscription at any time in your Apple Account settings (Settings, then your name, then Subscriptions). Cancelling stops future renewals; you keep access until the end of the period you already paid for. Deleting the app does not cancel a subscription.
• Restoring. Your subscription is tied to your Apple ID. Tap Restore Purchases on the Dendrites Plus screen to restore it on another device.
• Price changes. If the price changes, Apple will notify you in advance as required by its policies.
• Puzzle catalogue. The daily puzzles are built into the app. Each year's catalogue runs for a set season; new daily puzzles after that season require an app update. Past puzzles remain playable.

4. Purchases and refunds

• All purchases are processed by Apple. We do not process payments and cannot issue refunds. Refund requests are handled by Apple under its policies at reportaproblem.apple.com.
• Parents and guardians can require approval for purchases, or turn them off, using Ask to Buy and Screen Time on the child's device.

5. Not a medical product

Dendrites is a game. It is not a medical, therapeutic, or brain-training product and is not intended to diagnose, treat, prevent, or improve any condition or cognitive ability.

6. Privacy

Dendrites does not collect personal data. See our Privacy Policy.

7. Changes and availability

We may update, change, or stop offering Dendrites, its puzzles, features, or prices at any time. We may also update these terms; the effective date above will change when we do. Continuing to use the app after an update means you accept the new terms.

8. Disclaimer of warranties

To the maximum extent permitted by law, Dendrites is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of saved progress or records, arising from your use of or inability to use Dendrites. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid for Dendrites Plus in the twelve months before the claim, or US $50.

10. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Dendrites and its developer from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the app or your violation of these terms.

11. Dispute resolution

• Talk to us first. Before filing a claim, email us at pixxlpickle@gmail.com and describe the problem. We will try to resolve it informally within 60 days.
• Individual arbitration. If we cannot resolve a dispute informally, you and we agree that any dispute arising from these terms or Dendrites will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either of us may instead bring an individual claim in small claims court if it qualifies.
• No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective, or representative proceeding.
• Opting out. You can opt out of this section by emailing us within 30 days of first using Dendrites with the subject line "Arbitration opt-out".
• Refunds and billing for purchases are handled by Apple and are not covered by this section. If the class-action waiver is found unenforceable for a claim, that claim will go to court instead of arbitration. Where local law does not allow these terms, they do not apply to you.

12. Governing law

These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any claim that is not arbitrated will be brought in the state or federal courts located in North Carolina. Nothing in these terms limits rights you have under the consumer protection laws of the place where you live.

13. Children and parents

If you are under the age of majority where you live, use Dendrites and subscribe only with a parent or guardian's permission. Parents and guardians are responsible for purchases made on devices they manage and can control them with Ask to Buy and Screen Time.

14. Ownership

Dendrites, including its name, puzzle designs, level catalogue, artwork, and code, is owned by its developer and protected by intellectual property laws. All rights not expressly granted in these terms are reserved.

15. General

If any part of these terms is found unenforceable, the rest stays in effect. These terms, together with Apple's license agreement and our Privacy Policy, are the entire agreement between you and us about Dendrites. Not enforcing a provision is not a waiver of it.
